Terms & Conditions

PayAVan applies different terms depending on how you use the platform. If you post a job and receive bids, the Bidding Terms apply. If you book at an instant price, the Instant Prices terms apply, depending on whether you are a private or business customer. Select the set that applies to you below.

Bidding Terms & Conditions

These terms apply when you post a job and receive bids from drivers (our "Bidding" model). By posting a job, placing a bid, or accepting a bid on PayAVan, you agree to these terms. Please read them carefully.

About us

1.1

payavan.com (the "Site") is operated by Altaf Patel, a sole trader trading as "PayAVan" ("we", "us", "our"), based in England.

Our role — we are an intermediary, not a carrier

2.1

PayAVan provides an online platform that connects customers who need goods moved ("Customers") with independent, self-employed drivers and transport providers ("Drivers"). We do not provide transport services ourselves.

2.2

When a Customer accepts a Driver's bid, a separate contract for the transport of goods is formed directly between the Customer and that Driver. PayAVan is not a party to that contract. We act only as an intermediary that introduces the parties and processes payment on the Driver's behalf.

2.3

Drivers are independent contractors. They are not employed, controlled, or directed by PayAVan, choose which jobs to accept, and set their own availability. We do not guarantee the performance, conduct, punctuality, or quality of any Driver.

How the Bidding model works

3.1

A Customer posts a job describing the goods, locations and requirements. Each job has a minimum price set by PayAVan; Drivers may bid at or above that minimum.

3.2

Bids are offers made by Drivers on their own terms. A bid becomes a binding contract between the Customer and the Driver once the Customer accepts it.

3.3

A bidding deadline may apply. We do not guarantee that any job will receive bids, or that it will be fulfilled.

3.4

We may, at our discretion, moderate, edit or remove any job posting or bid that breaches these terms or our content standards.

Payment

4.1

The Site is free to browse. When a Customer accepts a bid, the full agreed price is payable immediately to PayAVan through our payment provider (Stripe). We collect this payment as agent for the Driver.

4.2

We retain a commission (the difference between the price paid by the Customer and the amount passed to the Driver) as our fee for providing the platform and payment service. The Driver's share is released to the Driver after the job is marked as delivered.

4.3

All prices are in GBP. Drivers are responsible for accounting for their own tax and VAT (if applicable) on the services they provide.

Cancellations and refunds

5.1

A Customer may cancel before a bid is accepted and paid for at no charge. Once a bid is accepted and paid, the contract is formed with the Driver and cancellation terms are a matter between the Customer and the Driver.

5.2

Where a Driver cancels before carrying out the job, or fails to perform, the Customer may request a refund from us of the amount paid. We will review such requests and, where appropriate, refund the Customer or help arrange an alternative Driver. Refund requests should be made within 30 days of payment.

5.3

We are not obliged to refund our commission where a job has been completed.

Responsibility for the move

6.1

Because the transport contract is between the Customer and the Driver, the Driver — not PayAVan — is responsible for the safe collection, transport and delivery of the goods, and for any loss or damage caused during the move.

6.2

Any claim for loss, damage, delay or non-performance must be pursued against the Driver who carried out (or agreed to carry out) the job. PayAVan will provide reasonable assistance to help resolve disputes but accepts no liability for the transport itself.

6.3

Drivers are required to hold their own valid insurance (including Goods in Transit and motor insurance) appropriate to the work. We may ask Drivers to evidence this but do not warrant its adequacy.

Customer obligations

7.1

You confirm that you own the goods or have permission to move them, and that they are not illegal, stolen, hazardous or prohibited.

7.2

You must provide accurate pickup and delivery addresses, access information, item details and contact details, and be available (or represented) at collection and delivery.

7.3

Location and distance information on the Site is based on postcodes and is for guidance only.

Prohibited use and conduct

8.1

You must not use the Site for any unlawful or fraudulent purpose, upload harmful or unlawful content, or attempt to disrupt the Site.

8.2

Customers and Drivers must not arrange jobs "off-platform" to avoid fees, share contact or payment details to circumvent the Site, or place fake bids. We reserve the right to suspend accounts and charge the fee that would have applied.

8.3

Drivers must not bid on their own jobs or misrepresent their services.

Reviews and feedback

9.1

Customers and Drivers may rate each other after a job. Feedback must be honest, lawful and not abusive. We may remove feedback that breaches these terms.

9.2

Feedback must not be used to threaten, coerce, or obtain goods or services outside the original job.

Our liability

10.1

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited under English law.

10.2

Subject to that, PayAVan's role is limited to providing the platform and payment service. We are not liable for the transport services, for the acts or omissions of any Driver or Customer, or for any indirect or consequential loss. Our total liability to you arising from your use of the Site is limited to the commission we received on the relevant job.

10.3

The Site is provided "as is". We do not guarantee it will always be available or error-free.

Your information

11.1

We process your personal information in accordance with our Privacy Policy. By using the Site you consent to that processing and confirm your details are accurate.

Changes, law and jurisdiction

12.1

We may update these terms by amending this page; the version in force is the one published here at the time you use the Site.

12.2

These terms are governed by the law of England and Wales, and the English courts have exclusive jurisdiction.
